Last updated April 23, 2024

We are Stozu LTD ("Stozu", "Company", "we", "us", or "our"), representing Stozu. Our company is based in Bulgaria (Sofia) but we have servers in Germany, USA, Singapore and Finland too.

We own and operate the website https://stozu.net (the "Site"), along with any associated products and services that are governed by these legal terms (the "Legal Terms") (collectively, the "Services"). You can reach us via email at support@stozu.net.

These Legal Terms establish a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Stozu LTD, regarding your use of the Services. By accessing the Services, you confirm that you have read, understood, and agreed to abide by these Legal Terms.

IF YOU DO NOT ACCEPT ALL OF THESE LEGAL TERMS, YOU ARE NOT AUTHORIZED TO USE THE SERVICES AND MUST CEASE USE IMMEDIATELY.

2. Definitions

Content includes various types of information like data, files, text, images, or any other material that you can post, upload, link to, or make available through the Services, regardless of its format.

Account refers to a distinct account established for you to access our Service or specific sections of our Service.

3. Acknowledgement

Additional terms and conditions or related documents that may appear on the Services periodically are incorporated into these terms by reference.

We reserve the right to modify these Legal Terms at our discretion. Changes will be communicated by updating the 'Last updated' date of these Legal Terms. By using the Services after updated Legal Terms are posted, you are considered to have accepted these changes.

It's your responsibility to review these Legal Terms regularly for updates. The Services are intended for users aged 13 and above. Minors (usually under 18) must have parental permission and supervision to use the Services. If you're a minor, your parent or guardian must read and agree to these Legal Terms before you can use our Services.

4. Privacy Policy

We prioritize data privacy and security. Please review our Privacy Policy: https://stozu.net/terms (accessible from the menu aside or links in the footer).

By using the Services, you agree to be bound by our Privacy Policy, which is part of these Legal Terms. Please note that the Services are hosted in Bulgaria, Europe, and the United States. If you access the Services from a region with different laws or requirements regarding personal data collection, use, or disclosure than those in Bulgaria, Singapore, Europe, or the United States, you consent to the transfer and processing of your data in Bulgaria, Europe, and the United States by continuing to use the Services.

Additionally, we do not knowingly collect, request, or solicit information from children or market to children. As per the U.S. Children's Online Privacy Protection Act, if we become aware that anyone under 13 has provided personal information to us without verifiable parental consent, we will promptly delete that information from the Services.

5. Acceptable Use Policy

Please take a moment to review our Acceptable Use Policy, which forms an essential part of our agreement. Engaging in any prohibited activities may result in the Company suspending or terminating your service and/or account.

6. Identity & User accounts

To access the Services, you may need to register. You agree to maintain the confidentiality of your password and are responsible for all activities carried out using your account. Please refrain from sharing your password with any third party.

It's important to provide accurate, complete, and current information at all times. In cases deemed high-risk or fraudulent at our discretion, we may request identity verification.

7. Billing

You agree to provide accurate billing information, including your full name, address, and a valid payment method. Once your payment is received, your order will be automatically fulfilled, and you will receive service details via email. If you don't receive this information promptly (within 35 minutes), please contact us for assistance.

Our billing cycle is as follows:

  • An invoice will be generated 14 days before your service expires, and you will receive an email notification.
  • A second notification will be sent 7 days before your service expires.
  • If the invoice remains unpaid by the due date, your service will be suspended 2 days after the due date.
  • If your service remains suspended for 7 days, it will be terminated, all data will be permanently deleted, and you will no longer be able to renew your service.

You can also manually generate invoices for your service at any time from the client zone by clicking the "Generate Invoice" button.

8. Subscriptions

If you have set up a subscription payment, you will be automatically billed. You can cancel the renewal of your subscription at any time by submitting a cancellation request through the billing panel. Make sure to also cancel associated payment subscriptions, such as PayPal, to prevent automatic payments after your service ends.

9. Refunds & Chargebacks

No refunds are provided for "End of Billing Period" cancellation requests. Your service will remain active until the next invoice's due date, after which no further charges will apply.

Refunds are only issued within our 14-day refund policy. If a service is terminated due to a refund request, all files associated with that service will be permanently deleted.

You can request a refund within 14 days of the initial payment and activation by contacting us and submitting an immediate service cancellation request through our billing panel. Refunds are limited to one per customer. Refunds requested outside the 14-day period are at the discretion of the Company. Typically, outside this period, we may provide a partial refund in the form of credit if there is a valid reason for it. Non-refundable items include one-time installations/setups, account credit balances, and products that require direct installation by us.

Initiating a chargeback will result in immediate termination of services and may lead to a ban from all Company services. If a chargeback dispute is ruled in the customer's favor and we suspect fraud, we reserve the right to take legal action. Services will be suspended during any payment dispute or chargeback until the issue is resolved. The Company reserves the right to terminate your account at any time.

10. Typographical Errors

If a product or service is listed at an incorrect price or with incorrect information due to typographical error, we reserve the right to refuse or cancel any orders placed for that product or service at the incorrect price. This applies whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged and your order is canceled, we will promptly issue a credit to your credit card account or other payment account for the amount of the charge.

11. Content

You are permitted to host Content on our Service, but you are solely responsible for ensuring its legality, reliability, and appropriateness. You must own the Content, have the right to use it, and ensure that it does not infringe on anyone's rights.

Content Restrictions:

  • You are accountable for your Content and any activity under your account.
  • Do not post unlawful, offensive, or rights-infringing content, including:
  • - Promoting illegal activities.

    - Discriminatory or hateful remarks based on religion, race, sexuality, etc.

    - Malware or harmful software.

    - Violations of proprietary rights.

    - Impersonation of others.

    - Breaching privacy.

    - Participating in DDoS attacks.

The Company reserves the right, at its discretion, to assess whether any Content complies with these Terms and may refuse or remove such Content. While the Company may edit the presentation of Content, it is not obligated to do so. Posting objectionable Content may result in limitations or termination of your use of the Service.

As the Company does not monitor all user or third-party content on the Service, you acknowledge the risks associated with its use. You understand that you may encounter content that you find offensive, indecent, or objectionable. The Company will not be liable for any content, including inaccuracies, or any loss or damage resulting from your interaction with such content.

12. Severability

If any provision of this Agreement is deemed unenforceable or invalid, that provision will be modified and interpreted to achieve the intent of the provision to the fullest extent permitted by applicable law, and the remaining provisions will remain in full force and effect.

13. Governing Law

These Legal Terms are governed by and construed in accordance with the laws of Bulgaria, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer with habitual residence in the EU, you also benefit from mandatory consumer protection laws in your country of residence. The Company and you both agree to submit to the non-exclusive jurisdiction of the courts of Sofia, Bulgaria. This means that you may assert your consumer protection rights under these Legal Terms in Bulgaria or in the EU country where you reside.

14. Limitations of Liability

To the fullest extent permitted by applicable law, the Company's and its suppliers' total liability under these Terms shall be limited to the amount actually paid by you for the Service.

The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, data, or other intangible losses, business interruption, personal injury, or loss of privacy, whether arising from the use or inability to use the Service, third-party software or hardware related to the Service, unauthorized access, statements or conduct of any third party, or any other matter relating to the Service, even if the Company has been advised of the possibility of such damages.

Some jurisdictions do not permit certain exclusions or limitations of liability, so in such states, the Company's liability will be limited to the maximum extent permitted by law.

These Terms of Service do not affect your statutory rights as a consumer, nor do they exclude or restrict the Company's liability for fraud, criminal actions, or any liability for death or personal injury resulting from the Company's negligence.

15. Term and Termination

We reserve the right to suspend or terminate your account at any time, without prior notice or specific reason, if we believe there is a violation of laws, regulations, our standards, or internet norms. Upon termination, your access to the Service will cease immediately. If you wish to close your account, simply discontinue using the Service. If you want us to delete your data, please refer to our Privacy Policy and contact us for further assistance.

16. Disclaimers

The Service is provided "as is" and "as available," with all faults and without any warranty of any kind. The Company, its affiliates, licensors, and service providers disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and those arising from course of dealing, performance, or trade usage. We make no guarantees regarding the operation, availability, compatibility, uninterrupted function, accuracy, reliability, or freedom from harmful components such as viruses or malware of the Service. We do not warrant that any errors or defects will be corrected.

Additionally, we do not provide warranties or representations regarding the accuracy, completeness, or safety of the content provided or linked through the Service. Your use of the Service is at your own risk, and we are not liable for any harm, damage, unauthorized access, interruption, bugs, or errors that may result from its use.

Some jurisdictions may not allow certain warranty exclusions, and if that applies to you, these exclusions may not be enforceable. In such cases, these exclusions will be limited to the maximum extent permitted by law.

When interacting with third-party products or services, exercise caution and judgment. Always be mindful of potential risks and take appropriate precautions.
